NYT Illustration and NFCC

I recently removed File:Judge_John_Hodgman_Rules_illustration_from_The_New_York_Times_Magazine_by_Kreh_Mellick.png from this article as an NFCC violation, and on my talk page DoctorWho42 (in a completely nice and civil way - thanks for that Dr!) asked about restoring it. I thought I would put my reasoning for the removal here, so that future editors can see the discussion.

I note that the illustrator gave permission to use the image via e-mail, but he likely does not own the copyright (as I believe it was a work for hire from the New York Times), or opted not to release it on a free license, and as such its inclusion here would have to follow the WP:NFCC guidelines for fair use. I think it violates WP:NFCC#3b and possibly WP:NFCC#8. I note that the image itself provides no rationale for WP:NFCC#1 and WP:NFCC#2, but I think that is not an insurmountable barrier, as this is a logo and generally logos of this nature are not released under free licenses. The WP:NFCC#3b argument (which I consider the strongest), is that the logo is not essentially different from the podcast logo (both are essentially just busts of John Hodgman in a judge's outfit, with a gavel nearby), and so we can basically convey the same iconography and branding just using the podcast title card. The WP:NFCC#8 argument is that the logo itself is not critically discussed in the article itself. We could of course just write something up about the logo, but if the logo itself has not been a subject of critical discussion off-wiki, then that would be unsourced original research.

My thinking on the matter is that the illustration should be removed unless the copyright holders are willing to release it under a free license, or unless the logo itself is given enough critical attention that a critical discussion of the logo can be included here with due weight in the reliable sources. At that point, it would pass the WP:NFCC#8 concerns, and depending on the nature of the discussion possibly also the WP:NFCC#3b concerns as well. 0x0077BE [talk/contrib] 13:05, 22 October 2014 (UTC)[reply]
